State voting rules for North Carolina

North Carolina voters abroad need to request a ballot each calendar year they want to vote in.

Ballot Challenge Information -- Updated April 17, 2025: 

Guilford County Overseas Voters: Your ballot from the 2024 NC State Supreme Court election is at risk of being disqualified. 

Based on a brand-new ruling from the NC Supreme Court, overseas voters in Guilford County must have provided a photo ID when registering to vote, and voters who registered as "never lived in the US" are not eligible to vote in NC state elections. 

If your ballot is at risk of being disqualified, you may be able to fix it! 

Guilford County is preparing to send out instructions to all affected voters. Once those instructions are sent out, you'll have 30 days to fix your ballot: 

  - If you didn't provide a photo ID when registering to vote, you'll be instructed how to provide one now.

  - If you registered as "never lived in the US", but you have lived in NC, you can submit a form to update your status.

Type of Ballot Based on Voter Category

If you choose “My Return is Uncertain,” you will receive a ballot to vote in federal, state, and local elections.

"Intend to Return" means you have an intention to return in the future -- but you don't need a set date or specific plans.
If you choose “Intend to Return,” you will receive a ballot to vote in federal, state, and local elections. But this may be one of several factors used to determine whether you may be subject to North Carolina state income tax.

If you choose “I've Never Lived in the US,” you will receive a ballot to vote in federal elections only (US President, US Senate, and US House of Representatives).
You won't be eligible to vote in North Carolina state or local elections (Governor, State Legislature, School Board, etc).
